Welcome and thank you for visiting WWTelemedicine and reviewing our Terms and Conditions.

1. Acceptance of the Terms

These Terms and Conditions (“Terms”) form a legal agreement between WWTelemedicine LLC its subsidiaries, representatives, affiliates, officers and directors (collectively “WWTelemedicine,” “we,” “us” or “our”) and you, the individual (individually “Client,” collectively, “Clients,” “you” or “your”) concerning your access and use of the various services offered through our websites and digital platforms (“Digital Platforms”). Use of any of WWTelemedicine Digital Platforms constitutes your acceptance of these Terms and Conditions and Privacy Policy. WWTelemedicine Digital Platforms enables you to conveniently find, request, receive or access to life coaching, mental coaching, and/or health advice services (individually “Service” or collectively, the “Services”) from third-party providers. These Terms govern your access or use, from within any worldwide territory. PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND WWTELEMEDICINE. BY USING ANY OF OUR SERVICES, VISITING ANY OF OUR DIGITAL PLATFORMS OR ACCESSING IN ANY WAY ANY MATERIALS, YOU AGREE TO AND ARE BOUND BY THESE TERMS, OUR PRIVACY POLICY, AND ANY OTHER TERMS WHICH MAY APPLY TO YOU. IF YOU DO NOT AGREE TO THESE TERMS OR THE PRIVACY POLICY, YOU MUST NOT ACCESS OR USE OUR SERVICE, DIGITAL PLATFORMS OR MATERIALS. In these Terms, the words “including” and "include” mean “including, but not limited to.”

WWTelemedicine owns and operates (i) various publicly available websites, including without limitation globalmentalcoaches.com, globalmentalcoach.com & wwtelemedicine.com (collectively, "Websites") and (ii) various web-based and mobile applications that require you to create an account in order to use a WWTelemedicine Digital Platforms.

We reserve the right to change these Terms at any time, without any prior notice to you. Any updates to these Terms will be posted or linked to our Digital Platforms. You agree that you will periodically check the Digital Platforms for updates to this Terms and each time you use the Digital Platforms and Services so you are aware of any changes, as they are binding on you.

All online health consultations and coaching services are provided solely by third-party independent providers (individually, a "Provider," and collectively, the "Providers"). All Providers are not employees or agents of WWTelemedicine. WWTelemedicine neither endorses nor is responsible for the accuracy and reliability of any products, services, events, opinions, advice, or statements made by the Providers and/or any other third-party. 

In countries or states that require a valid active local license by the Provider and the Provider is not licensed locally, the Client, by booking the Service, is accepting to receive a coaching session. The Providers are independent of WWTelemedicine and are merely using the Digital Platforms as a way to communicate with the Clients. Any information or advice received from a Provider comes from them alone, and not from WWTelemedicine.

Your interactions with the Providers via the Digital Platforms are not for medical emergencies or urgent situations nor intended to replace your relationship with your regular healthcare practitioners or primary care physician. You acknowledge that your reliance on any Providers or information delivered by the Providers is solely at your own risk and you assume full responsibility for all risks associated herewith. WWTelemedicine does not make any representations or warranties about the training or skill of any Providers who deliver Services to you. You will be connected with an available Provider based solely on the information you submit in the Digital Platforms. You are ultimately responsible for deciding to accept the Services of your particular Provider. Neither WWTelemedicine or any third party who may promote WWTelemedicine or provide a link to WWTelemedicine, shall be liable for any Service obtained from a Provider via WWTelemedicine, nor any information obtained on the Digital Platforms.

IMPORTANT: PLEASE BE ADVISED THAT THIS AGREEMENT CONTAINS PROVISIONS THAT GOVERN HOW CLAIMS BETWEEN YOU AND WWTELEMEDICINE CAN BE BROUGHT, INCLUDING THE ARBITRATION AGREEMENT (SEE SECTION 2 BELOW). PLEASE REVIEW THE ARBITRATION AGREEMENT BELOW CAREFULLY, AS IT REQUIRES YOU TO RESOLVE ALL DISPUTES WITH WWTELEMEDICINE ON AN INDIVIDUAL BASIS AND, WITH LIMITED EXCEPTIONS, THROUGH FINAL AND BINDING ARBITRATION (AS DESCRIBED IN SECTION 2 BELOW). BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION.

WWTelemedicine may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.

2. Arbitration Agreement

Clients, Providers and WWTelemedicine agree that any dispute, claim, or controversy in any way arising out of or relating to (i) these Terms and prior versions of these Terms, or the existence, breach, termination, enforcement, interpretation, scope, waiver, or validity thereof; (ii) your access to or use of the Services at any time; (iii) incidents or accidents resulting in personal injury to you or anyone else that you allege occurred in connection with your use of the Services including, but not limited to, your use of the WWTelemedicine Digital Platforms, regardless whether the dispute, claim, or controversy occurred or accrued before or after the date you agreed to the Terms, and regardless whether you allege that the personal injury was experienced by you or anyone else; and (iv) your relationship with WWTelemedicine, will be settled by binding individual arbitration between you and WWTelemedicine, and not in a court of law. This Arbitration Agreement survives after your relationship with WWTelemedicine ends, and will apply to you prospectively.

3. Providers

As a Provider, WWTelemedicine offers you the right to use our Digital Platforms to offer your Provider Services with our community of Clients. When you receive a booking confirmation through the Digital Platform, you are entering into a contract directly with the Client, and are responsible for delivering your Provider Service under the terms and at the price agreed. You are also agreeing to pay applicable fees for each booking.

You acknowledge that being a Provider carries inherent risks and agree that you assume the entire risk arising out of your access to and use of our Digital Platforms, offering Provider Services, or any interaction you have with the Clients. You agree that you have had the opportunity to investigate the WWTelemedicine Digital Platform and any laws, rules, regulations, or obligations that may be applicable to your Provider Services and that you are not relying upon any statement of law made by WWTelemedicine.

As a Provider, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable VAT or other indirect taxes, income, or other taxes ("Taxes").

Some countries and states require Providers to be licensed to practice a health advice profession. The unlicensed practice, performance or delivery of medical or health services to Clients in some countries or states without a local valid, active license to practice that profession, regardless of the means of the performance or delivery of such Services, may be prohibited.

All Providers registrants are required to maintain either professional liability coverage or financial responsibility that includes coverage or financial responsibility for Services provided to Clients not located in the provider’s home state or country.

4. User Registration and Account Security 

By registering on the Platforms, you represent and warrant the following: (i) you are at least eighteen (18) years of age, (ii) you have the legal ability and authority to enter into these Terms with WWTelemedicine, (iii) the information you have provided to WWTelemedicine in your registration is accurate and complete, (iv) you will comply with any and all laws applicable to your use of the Digital Platforms and Services.

Account creation

While you can browse our websites without creating a user account (“Account”), the purchase of any Services, requires you to have an Account. In creating an Account, you must provide us with accurate and complete registration information as prompted during the registration process, including your name, a valid email address which functions as your username and a password of your choice, subject to certain requirements. Each Account registration is for a single user only. You may not misrepresent your identity or your affiliation with any person or organization and you may never use another user’s Account for any purpose whatsoever.

Account Security.

You are responsible for maintaining the confidentiality of the username and password that you designate during the registration process, and you are fully responsible for all activities that occur under your username and password. You agree to (a) immediately notify WWTelemedicine of any unauthorized use of your username or password or any other breach of security related to your account, and (b) ensure that you exit from your account at the end of each session. WWTelemedicine will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. If you share your computer with others, you may wish to consider disabling any auto-sign in feature if you have linked your WWTelemedicine account to any electronic mail service or other account.

5. Geographic Restrictions 

WWTelemedicine operate subject to state and country regulations. By using WWTelemedicine Digital Platforms you acknowledge that you are legally permitted to use it under your country, state and local law. Accessing the Digital Platforms and Services in a country or a state or jurisdiction where the content of the Digital Platforms or the use of the Service is illegal is strictly prohibited.

6. Pricing and Fees

WWTelemedicine may charge fees (and applicable Taxes) to Providers and Clients for the right to use the Digital Platform. Most WWTelemedicine fees are under 15% of the booking subtotal. Fees are non-refundable. WWTelemedicine reserves the right to change the fees at any time. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement.

In the event a Service is listed at an incorrect price due to typographical error or error in pricing information received from a Provider or third-party, we shall have the right to refuse or cancel any bookings placed for the Service(s) listed at the incorrect price. We shall have the right to refuse or cancel any such bookings whether or not it has been confirmed and your credit or debit card charged. If your credit or debit card has already been charged for the purchase and your order is canceled, we will promptly issue a credit to your credit or debit card account in the amount of the charge.

7. Copyright and Trademark

You are not authorized to use, post, distribute, or reproduce in any way any of WWTelemedicine copyrighted material, trade names, trademarks, service marks, logos, and slogans in any advertisement, publicity or in any other commercial manner without our prior written consent.
